Consumer Education Seminar on “ Recovery Agents : Helping or Harming?”
held on Wednesday 28.11.2007 in the Indian Merchants' Chamber Hall.

The President Mr. Dinesh Parekh welcomed the audience and briefed about the activities of CFBP. He stated that we all have been noticing several cases in the Media about excesses committed by Recovery Agents, due to which the borrower was forced to take extreme steps like commiting suicide. In order to educate the consumers about their rights to handle the harassment at the hands of recovery agents, the seminar has been organized by CFBP.

Mr. Subash Chander Gogia , Chairman, Programmes Committee introduced the speakers namely. Mr. S.C. Kothari , Partner, Kanga & Company,Mr . Anand Patwardhan , Advocate,Mr . Arun Wable , Sr. Police Inspector, Cuffe Parade Police Station, Mr . Davidson , General Manager , IDBI,Mr . J.N. Natarajan , Dy.General Manager, Karur Vysya Bank,Mr . Mukesh Kumar, Standard Chartered Bank, Mr.A.A.Taj , General Manager, CRLD, Union Bank, Mr. Ashok Nayyar , Dy . General Manager, SBI, Mr. Shakil Khan, DY. General Manager, ICICI, Mr.Atul Gautam , General Manger, Oriental Bank of Commerce. He then requested Mr. S.C. Kothari, Partner, Kanga & Co. to give his address on the above subject.

Mr. Kothari stated that nobody has right to take the law in his hands. Basic principles of democracy and constitution of India legislation is done with a view to give a right for remedy to every citizen who has any grievance against any establishment or any person. The concept of recovery agents according to Supreme Court is nothing but muscle power with revolver in hand with recovery agents. He stated that the recovery agents do more harm than helping and damage the reputation of the bank. He cited the Supreme Court observation against ICICI Bank which have earned a very bad name. The recovery agent - muscle man needs to be discouraged and they should resort to the procedure recognized by law to take possession of vehicles, in case the borrower may have committed default in payment of instalments. He also citied the observation of Justice Dr. A. R. Lakshmanan.
“ A man's self-respect, stature in society are all immaterial to the agent who is only primed at recovery. This is the modernized version of Shylock's pound of flesh. No explanation is given regarding the interest charge and the bank takes cover under the guise of the holder of the card or loan having signed the agreement whose fine print is never read or explained to the owner.” He also cited the statement of the Chairman of HDFC, Mr. Deepak Parekh who said that no Civil Society would allow the recovery agents to take the law into the hands. Every Bank practice a Code of Conduct which is available on the website of the banks. The banks are entitled to take possession of the property / vehicle but only through the process of law. If the amount is more than 10 lakhs , the cases will be decided by the Debt Recovery Tribunal and if it is less than 10 lakhs, case has to be filed in High Court. The Debt Recovery tribunal is normally faster than the High Court. If the amount of recovery is more than one lakh , notice is required to be given by the banks / financial institution to the borrower calling upon to pay otherwise and take appropriate action within 60 days for possessing the property/vehicle. While concluding, he endorsed the views of the Supreme Court on the excesses committed by the Recovery Agents and appealed to the Police Authorities to see the agreement between bankers and recovery agents and take appropriate action under the law.

 

Presentation by Mr. Anand Patwardhan

    Mr. Anand Patwardhan gave a detailed presentation and Remedies available to the consumers in defending from the harassment by recovery agents.

    Mr. Arun Wable, Senior Inspector, Cuffe Parade Police Station stated that the recovery agents are mostly from Private Security Agencies. There are 712 Security Agencies in Mumbai. As per Private Security Agency Act 2005, all the Security Agencies are required to obtain licence from police. Mr. Wable stated that about 250 applications for licence have been received so far, but only one Agency has been granted licence . Most of the banks appoints security agency working as Recovery Agents but they have not obtained necessary permission from the Police. He assured that the police will always give a helping hand to the common man. If any person is being harrassed by the Recovery Agents, he can approach concerned Police Station with a proper written complaint.

    Thereafter the representatives of IDBI Bank ,SBI and ICICI stated that the banks want to treat all customers equally with dignity. They agreed that there may be some excesses commited by the Recovery Agents. But in general the main aim of the banks is to recover dues from the borrower. Everybody felt that a suitable legislation is required to streamline the recovery processes and lessen the hardship to the common man / borrower.

Mr. F.T. Khorakiwala, Past President of CFBP stated that the aggrieved party who has been harassed by the Recovery Agents should approach the police and lodge an FIR then only the police can act on the complaint. The police will not be able to do anything, unless an FIR is lodged. He also endorsed the idea of formulating a suitable legislation protecting the consumers as well as interest of the banks and financial institution.

RBI Mantra for Recovery Agents

Check them Out : RBI wants banks to carry out a background check on recovery agents before employing them.

Tell Agents to carry visiting cards : While forwarding default cases to recovery agents, wants bank to give details, including telephone numbers, of the recovery agent to borrowers. Recovery agents should call borrowers only from these telephone numbers.

What if there's trouble? : While giving details of recovery agents, bank should also inform borrowers whom to approach in case they have grievances with regard to them recovery process.

Don't give them an incentive to kill : Banks have been advised to lower targets and incentives to ensure recovery agents are not tempted to adopt unlawful methods against borrowers.

Bank must read our circulars carefully: They have been asked to dig out an old circular (May, 2003) regarding Guidelines on Fair Practices Code for Lenders and another (July, 2007) on credit card operations which advise bank to ensure recovery agents refrain from action/s that could damage the reputation of the bank.

Teach them manners: Ensure recovery agents are properly trained to handle with care and sensitivity aspects like hours of calling, privacy of customer information, etc

Send them to school : RBI wants all Direct sales Agents/Recovery Agents to take a certificate course(minimum100 hours of training) to be formulated by Indian Institute of Banking & Finance.

Court the Law to Recovery Dues: Recovery of loans – personal, credit card or housing- less than Rs . 10 lakh can be dealt with by Lok Adalats (Supreme Court ruling)

The Buck stops with the Bank: Bank must be responsible for action of their agents and ensure they adhere to RBI guidelines while recovering dues from borrowers.

And, if a bank defaults … : RBI may consider banning the bank from engaging recovery agents in a particular area, either jurisdictional or functional , for a limited period. In case of repeated complaints, RBI may extend the ban or the area of the ban. Similar action might follow if courts pass strictures against any bank or its officials.

Thereafter, Finance Minister on 4 th December, 2007 has warned that PSU Banker Found Hiring Musclemen will be sacked.
